1.1. By placing an order with Hot Tubs Omagh Ltd, you are consenting to the following Terms and Conditions.
1.2. Our acceptance of your order establishes a legally binding contract.
1.3. Legal ownership of any goods ordered from Hot Tubs Omagh Ltd will not pass to you until full payment has been received.
2.1. All prices shown on Hot Tubs Omagh Ltd website or price lists are in (£) Pounds Sterling, and include VAT at the current rate, errors and omission excepted.
2.2. Delivery is not included in the price unless stated otherwise, and will form an additional charge.
2.3. Hot Tubs Omagh Ltd will notify you prior to acceptance of the order if there are any amendments or alterations to the price of the goods or services requested.
2.4. The manufacturers reserve the right to change the specification of their products at any time. If this means the price has been amended or altered, you will be entitled to cancel the order and receive a full refund where applicable.
2.5. A non- refundable deposit for goods or services must be made at the time the order is placed (minimum 10%). Balance of account must be paid in full 5 days prior to delivery. Goods, either new or second hand, which have had a deposit paid should be collected or delivered within a 3 month period unless a written agreement stating otherwise has been made and agreed in advance with the company. An extended holding time of 3 months can be arranged by making a further payment of 50% of the outstanding balance. Once the agreed time has lapsed, and goods have not been collected or delivered, we reserve the right to dispose of the goods and all monies paid will be forfeited. Accounts paid meaning cleared funds in our Bank.
2.6. If goods are released prior to full order payment, you accept that we retain the right to demand and receive immediate settlement of all outstanding payments prior to transfer of ownership, or grant us unrestricted access to reclaim the goods. At this point a cancellation process shall be instigated. All Invoices remaining unpaid after 14days will incur a 5% credit charge per month.
2.7. All unpaid accounts will, after 30 days, automatically be referred to our solicitors for collection and at that point all additional fees in association with recovery of the debt will be added to the account for collection.
3.1 On the completion of repair of goods, the customer will be informed that the goods are ready for collection/delivery by either email, phone or with the issue of an invoice.
3.2. Any goods which should have been collected or delivered back to their owners will not be released without the account being paid in full; company policy states that all invoices are payable within 14 days of invoice date; a 5% per month interest charge will be added to the account if not paid by due date.
3.3. We reserve the right to charge storage (£20.00 per week) on any goods not collected/delivered after 14 days of invoice date. Accounts paid meant cleared funds in our Bank.
3.4. We will make all efforts to inform the customer that goods are ready for collection and or delivery; after a reasonable time has lapsed (14 days) and the invoice has not been paid and every effort has been made by the company to contact the owner, the company reserve the right to dispose of the goods and all charges will be deducted from the sale process, the surplus of moneys will be returned or the shortfall will be invoiced to the customer.
4.1. We will arrange delivery of the goods at the earliest opportunity, Hot Tubs Omagh Ltd reserve the right to adjust the delivery date following any unforeseen circumstances.
4.2. All delivery dates or lead times stated are approximate, and are given by Hot Tubs Omagh Ltd in good faith for indication purposes only. We cannot guarantee a specific delivery time or date, and cannot be held responsible for delays which are beyond our control, including (but not limited to) manufacturing issues and third party contracted companies.
4.3. We are not responsible for delays caused due to incomplete or incorrect information being submitted by ‘The Customer’.
4.5. It is the customer’s responsibility to provide a suitable access for delivery, and any concerns you have must be notified to us in writing at the point of order. If you do not notify us, you will be liable for any failed or return delivery charges. In the event of a crane being required to lift the goods over your home, or to place on a difficult site all costs involved will be the responsibility of the customer. The crane must be booked to be on site at a time agreed with Hot Tubs Omagh Ltd.
4.6. A valid signature from you or your representative must be provided upon delivery, at which point you bear all responsibility and risk for the delivered product.
4.6.1. If you are not available to sign for the goods upon delivery, prior written acceptance of responsibility must be provided to us, allowing the goods to be left unattended. If written acceptance of responsibility is not received prior to delivery, you will be liable for the failed and/or return delivery charges.
4.7. Goods must be examined within a reasonable time of delivery, and all damages or shortages must be reported as soon as possible by telephone to ( 028) 8 22 55 999, and thereafter in writing to Hot Tubs Omagh Ltd, 12 Ballynahatty Road, Omagh, Co. Tyrone, BT78 1PN. Hot Tubs Omagh Ltd will not accept any telephone claims which are not backed up immediately in writing (photographs should ideally be provided where possible).
4.7.1. No responsibility for transit damage will be accepted after 24hrs from the time of delivery.
4.7.2. If damage has occurred to sectional goods during transit, (retractable enclosures or log cabins) each section will be classed as an individual item. We reserve the right to replace only the damaged sections, and can decline any replacement when damage has been caused by ‘The Customer’ through misuse, neglect, self-assembly, or incorrect storage. Minor superficial damage caused during transit will not be accepted as grounds for rejection.
4.8. You should not begin installation, or arrange any third-party installation until the product has been fully inspected for damage or missing parts. Hot Tubs Omagh Ltd shall not be liable for any costs incurred by ‘The Customer’, should they fail to inspect and satisfy themselves that the product is sound and complete prior to self-assembly. If Hot Tubs Omagh Ltd personnel do not install the unit we do not accept any liability for damage caused by 3rd party or self-installation.
5.1. If an installation service has been requested and is available, ‘The Customer’ must ensure that a flat and level base of an adequate size to locate the product and capable of carrying the weight of the product should be provided prior to delivery. You will be advised of the electrical supply required and this must be provided by the customer to the area of installation.
5.1.1. The site should be clear of obstructions including, but not limited to, overhanging branches, and have sufficient unobstructed access (minimum 600mm) around the site for the safe installation and maintenance of the product. If the base does not meet the required standards, you will be liable for the aborted labour costs (18% of the product price or the initial installation fee, whichever is greater), and the product will be left for self-installation.
5.1.2. Should ‘The Customer’ require a return installation service, a similar charge (18% of the product price or the installation fee, whichever is greater) must be paid prior to the subsequent visit being made.
5.2. ‘The Customer’ must ensure that the installer’s vehicle can be parked as close as possible to the installation site. If a parking area cannot be located nearby the site, the installation may be abandoned and a return charge (as defined in 4.1.1.) may be made, and
5.2.1.) ‘The Customer’ will be liable for any costs incurred by the installation team (metered parking etc.) during the installation period.
6.1. If the goods have not been delivered, you can cancel the contract at any time from the day the contract is made until the expiry of 14 days following the day after receipt of the goods at our premises (except as defined in 5.2.). Cancellations must be made in writing either by letter or email.
6.1.1. An additional charge may be made if the order is cancelled after delivery has been scheduled by a third party.
6.2. ‘The Customer’ has no right to cancel at any time if the order includes special order items, non-standard options, adaptations, or personalised preferences. Products ordered for delivery direct to the customer from overseas (e.g. hot tubs, swimmers, retractable enclosures etc.) are non-returnable, and cannot be cancelled once shipping has commenced.
6.3. Minor cosmetic damage and natural variances in products such as knots, natural cracks and shakes in timber parts are not classed as imperfections or flaws, and not classed as faulty.
6.4. We will not accept any return or cancellation if the goods have been altered, assembled, painted or customised in any way.
6.5 Any items which we agree to re-stock will incur a 20% re-stocking charge
7.1. We will not accept liability for any product which does not meet ‘The Customers’ required dimensions, unless the exact dimensions have been obtained in writing from us, prior to order. All sizes shown are quoted as approximate, and may be changed at any time.
7.2. ‘The Customer’ should check before ordering that the product will be suitable for its intended purpose.
7.3. Hot Tubs Omagh Ltd will not accept liability for issues caused by the installation of any product by a third party.
7.4. If you do not receive goods ordered within 30 days of the date ordered (unless a longer delivery time had been agreed), we shall have no liability to you unless notified in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.
7.4. If we (or our suppliers) are unable to supply your order, we will refund you in full as soon as possible. We will not be obliged to pay any compensation for disappointment or inconvenience.

8.1. Hot tubs, swim spas and saunas are guaranteed for a period of 24 months from date of purchase. This is a parts and labour guarantee. Travelling to and from the customers address will be chargeable. Retractable enclosures and log cabins* are guaranteed for a period of 12 months and no labour or installation costs are covered. Customers own conditions of purchase or buyers standard conditions shall not apply unless accepted in writing in advance. We reserve the right to change our terms and conditions without notice. We understand and exercise our statutory right to interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms. These Terms and Conditions do not affect your statutory rights as a consumer. By ordering a product from Hot Tubs Omagh Ltd you are deemed to have accepted these terms and conditions.
9.1 Technician’s chargeable rates per hour. Hot Tubs supplied by Hot Tubs Omagh Ltd will have a 2 year Parts and labour warranty, unless otherwise stated. Mileage charges are still applicable on warranty call outs. The minimum call out charge is 1 hour (referred to as the call out charge and this begins from the moment our technician leaves our premises) and is for the 1st hour or part thereof, additional time is charged in 15 minute segments at the same hourly rate. Technician`s chargeable time on tubs supplied by Hot Tubs Omagh Ltd:
£40.00 call out. Technician`s chargeable time on tubs not supplied by Hot Tubs Omagh Ltd: £40.00 call out. Additional time is charged in 15 minute segments at: £10.00 per 15 minutes. Telephone advice is chargeable in 15 minute segments at: £10.00 per 15 minutes
9.2 Mileage charge: £2.00 per mile both ways. This covers wear and tear of our vehicle, insurance, fuel and technicians time whilst driving. Whenever possible we try and have at least 2 calls in your area, this means we can share the mileage between whatever calls are carried out on that day. If you want an urgent call out and we do not have another call in your area you will be liable for the complete mileage charge. Sometimes it is impossible to complete the work on one visit, we may have to return to complete the service or repair, as we may need to order parts, in this case unfortunately mileage will have to be charged for the second visit.
